Kor37 9 Posted March 9, 2007 Yesterday's jury duty was my best experience at this ever! During the morning session, they only called a few hundred people down to court rooms. They got up to number 400. My number was 830. We broke for lunch about 12:15. I went to Hooters and ate chicken wings and got loaded. After lunch, they never called another person down to the courtroom. They ended up dismissing us 1 1/2 hours early! Now THAT is what I call an almost perfect jury duty day! Kor37 9 Posted March 11, 2007 Busy day today. I have to do all of my payroll and other paperwork before noon because one of my sisters and her family are coming to visit from Minnesota today. Later on today, they will be taking my Dad and Eric down to Maryland's Eastern shore for a few days for a little vacation. I visited my car yesterday. The body is now 99% complete and looks great. The problem I have now is that from sitting all that time, the motor is in bad shape. It needs a major tune-up and all of the carbeurators need to be rebuilt. Yesterday was such a beautiful day I didn't feel like doing much so I spent much of the day laying in a hammock amidst the trees and flowers. I got this letter from the IRS yesterday wanting me to send part of one of my driver's pay every week to them to pay off his back taxes. All of my drivers are independant contractors. I don't take any taxes out of their pay. I'm not sure they can force me to do this. I'm going to check with my tax attorney about it. In the meantime, is anyone here versed in the law regarding this? My son Eric and I might see another movie today. I'm thinking of seeing "Ghost Rider". I'm in negotiations with another company to buy them out and almost double my business. All of my drivers are independant contractors. I don't take any taxes out of their pay. I'm not sure they can force me to do this. I'm going to check with my tax attorney about it. In the meantime, is anyone here versed in the law regarding this? You should check if they are really independent contractors or not. If they work on your business property, drive your business vehicles, use your business tools, etc. and have been doing so for over a year the IRS does not consider them independant contractors. They are considered employees. If that is the case then you not only need to withhold taxes but you must also pay taxes. The workers could even sue you for back vacation, sick pay, health and dental, basically all the benefits you would have to pay an employee. If they are indeed independent contractors then IN MOST CASES you do not need to withhold taxes. It is up to the contractor to pay his own taxes. HOWEVER, if he doesn't, then yes the IRS can order you to pay them directly out of his wages until his tax debt is paid off. Share this post Link to post Share on other sites

But then again garnisheing your pay for back taxes. always thoght they took you to court first. Are you a hands on restorer or are you having it done? Have restored cars since i was a teenager Body work, painting, motor everything. I left the house this morning with a bunch of paperwork and some of it fell out of my bag while I was getting into my van. Completely soaked! GREAT way to start the day...... On the brighter side, my disc brake conversion kit arrived in the mail yesterday. I'm going to change the front brakes of my car from drum to disc brakes. Today I have an appointment with my tax attorney to see if I can get out of having to garnish wages for one of my drivers. I hope I can get out of it because if I can't, the driver will have to quit... :) I'm also going to try and get some work done on my car this weekend....weather permitting of course. Kor37 9 Posted March 19, 2007 I've been a bit busy the last few days - Saturday night we took my father out to dinner because it was his birthday. Thats why I was late for the chat. During dinner, my wife gets a call saying that her father had been taken to the hospital. This is nothing really new. He had a stroke some years ago and has been in declining health ever since. He now has aspiratic pneumonia which is that when he eats, some of the food goes down the wrong way and ends up in his lung. Nothing much they can do about it except install a feeding tube in him which I think is what they are going to do. So after dinner my wife went to the hospital. - After I left the chat Saturday night, I had a whole new problem to tackle. My son Eric was supposed to return to Maine for school on Sunday morning. He takes 2 flights. One from Baltimore to Philadelphia and the other from Philadelphia to Bangor. When I checked his flight status, I found out that his flight from Baltimore to Philly had been cancelled because all of the weather problems. After being on hold for 2 HOURS......yes, I said 2 HOURS.. :) ....I found out that his Philly to Bangor flight was still on. So I asked the airline if I could get a refund on the Baltimore to Philly flight and I'll just drive him to Philly to catch the other flight. She told me that I would get a partial refund on the round trip ticket. Ok...so I make arrangements not to go to work that night and to drive Eric to Philly. Later, when I try to print out his boarding pass, I get a message saying that something on my ticket had changed. After another incredibly long wait on the phone, I found out that the incompetant airline employee cancelled the entire trip and had already sold his seat to someone else..... ......nothing they could do except rebook him for Tuesday morning. So now Eric has to miss 2 days worth of classes because of the incompetance of USAIR! How's that for a lovely weekend? Share this post Link to post Share on other sites
