Man torments children to enforce homeowner association rules

WILMINGTON, N.C. (AP) - A North Carolina homeowners association president has been ordered to stay away from children in his development after parents complained that he went too far in enforcing traffic rules.

 

Judges have ordered Dennis O'Bannon, 62, to stay away from several children in the Pelican Reef subdivision, the Star-News of Wilmington reported Thursday.

 

Parents complained that O'Bannon scares children with his truck while enforcing the traffic rules. In one case, a parent said O'Bannon came within inches of hitting his child, who was driving a golf cart.

 

"I think the man is a loose cannon," said Frank Boyce, 48, whose 13-year-old son was in the cart. "If he gets irritated enough, he's going to hurt one of the kids one day."

 

O'Bannon contends the parents are fabricating complaints because they are angry at his enforcement of rules in the neighborhood on U.S. 17 in Pender County, north of Wilmington. O'Bannon pleaded no contest to allegations in Pender County civil court, but said he did so to defuse the situation.

 

"They don't want to be responsible individuals, it's that simple," said O'Bannon, adding he is worried that children might get hurt.

 

Three families took O'Bannon to civil court, where documents said he confronted children ranging in age from 9 to 13 in separate incidents dating to last fall.

 

Nancy Hastings said she has received letters from the association threatening fines because her five children ride motorized scooters. The board banned children under 16 from using them.

 

Hastings and two other parents took the complaint to court last month and said they think the dispute stems from older residents who don't like children.

 

Maureen Biessener, 43, said in her complaint that O'Bannon has a "hot temper, which he freely displays to children and adults." Biessener added she is concerned that her daughter might be run over and drives her to a school bus stop two blocks away.

 

David Biessener, 45, said O'Bannon acts like he has police powers and veered in front of him March 31 when Biessener drove around some speed bumps. Biessener drove off the road to avoid stopping for O'Bannon, who later acknowledged his behavior was a mistake.

 

James Capps, a parent on the association board, said O'Bannon should have confronted the parents and not their children.

 

You gotta love these clowns that become the head of a "Homeowner Association" and immediately believe that they are the "King" of their neighborhood. Homeowner Associations are ridiculous and border on being unlawful. This bears out in court where in about 95% of lawsuits involving Homeowner Associations, the Homeowner Association usually loses.
